Odd Socks is published by Oak Games Mobile Ltd (“we”, “us”, “our”), a company registered in England and Wales with its registered office at 17 Salisbury Road, Ryde, Isle of Wight, PO33 1BY.
These terms apply to Odd Socks wherever you play it: on Facebook, on iOS, on Android through Google Play, on Amazon devices, and in a web browser. They form an agreement between you and us. Please read them, and please also read our Privacy Policy, which explains what information we hold about you and why.
1. Accepting these terms
By playing Odd Socks you agree to these terms. If you do not agree to them, please do not play the game.
We may change these terms from time to time, for example when we add features or when the law changes. When we do, we will update the effective date at the top of this page and post the change on our website. If a change is significant we will tell you in the game as well. Continuing to play after a change means you accept the updated terms.
2. Who can play
You must be at least 13 years old to play Odd Socks. We do not market the game to children under 13 and we do not knowingly collect their information. If you are under 18, please make sure a parent or guardian is happy for you to play and to make any purchases.
You may not play if we have previously closed your account for breaking these terms.
3. Your account
You sign in to Odd Socks with Facebook, Google, Apple or an email address and password. Your game progress is stored against that sign-in, so keeping access to it is what keeps access to your game.
- Keep your sign-in details to yourself. Anything done in your account is treated as done by you.
- Please do not sell, rent, share or transfer your account to anyone else.
- Please do not create extra accounts in order to gain an advantage, for example to send gifts to yourself or to fill a team.
- We strongly recommend adding a second way to sign in – an email address, or a link to Google or Apple – so that you can still reach your game if you ever lose access to your Facebook account. The game will offer to do this for you.
You can delete your account and everything we hold about you at any time from Menu → Account → Delete Account. This is immediate, it removes all of your progress and any unspent sock cash, and it cannot be undone.
4. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to play Odd Socks for your own private entertainment. We do not sell the game to you, and all rights we do not expressly give you here remain ours.
You agree not to:
- cheat, use bots, scripts, automation or modified clients, or exploit a bug rather than reporting it;
- interfere with the game servers, or attempt to access accounts, data or systems that are not yours;
- copy, decompile, reverse engineer or redistribute the game, except where the law says you may;
- use the game for anything commercial, including advertising or selling anything to other players;
- collect other players’ information, or contact them outside the game without their agreement.
5. Teams, chat and other players
Odd Socks lets you join a team, chat with your team, add friends and send and receive gifts. Anything you type into a team name, a team description, a screen name or a chat message can be read by other players, so please treat it as public.
When you write something in the game, you agree not to post anything that is:
- abusive, harassing, hateful, threatening or discriminatory;
- obscene, sexually explicit, or otherwise unsuitable for a game played by teenagers and adults together;
- an impersonation of someone else, including of us or our staff;
- spam, advertising, links to other services, or requests for money;
- someone else’s personal information, or your own information that you would not want made public;
- anything unlawful, or anything that encourages others to break these terms.
The game filters names and messages automatically for offensive words in a number of languages. The filter is not perfect: it will sometimes let something through and sometimes block a perfectly innocent word. Please tell us if you see something that should have been caught.
You keep ownership of what you write, but by posting it you give us permission to store it, show it to other players and moderate it, for as long as we run the game. We may remove any content, or rename a team, without notice.
We do not read every message, and we are not responsible for what other players say or do. Please report anything serious to us through Menu → Support.
6. Sock cash and other virtual items
Odd Socks is free to play. It also contains sock cash, coins, socks and other virtual items that you can earn by playing, receive as gifts, or buy with real money.
- Virtual items have no monetary value. They are not your property and they are not a balance held for you: they are a limited licence to use a feature inside the game.
- They cannot be exchanged for real money, transferred out of the game, or sold to anyone else.
- They exist only inside Odd Socks and only while we run it. If your account is closed or deleted, any unspent items are lost.
- We may change the price, the amount awarded, the way an item behaves, or how the game is balanced, and we may withdraw an item, at any time.
7. Purchases and refunds
Purchases are made through the store you play in – Facebook, the Apple App Store, Google Play or the Amazon Appstore. The store takes the payment, not us: we never see or store your card details. The store’s own terms and refund policy apply to the transaction, alongside these terms.
Virtual items are delivered to your account immediately. If you are a consumer in the UK or the EU, you normally have 14 days to change your mind about a digital purchase, but that right ends once delivery has begun – so by buying sock cash and receiving it straight away, you agree to immediate delivery and accept that the 14-day cancellation right no longer applies. Nothing here affects your legal rights if something is faulty or not as described.
If a purchase does not arrive, please contact us through Menu → Support and we will look into it. Refunds are otherwise a matter for the store you bought from.
Repeated chargebacks or fraudulent payments may result in your account being closed.
8. Advertising
Odd Socks offers optional video adverts that reward you in the game for watching them. These are supplied by third-party advertising companies, not by us.
Those companies decide which adverts you are shown and how many are available, and the number varies from player to player and from day to day. We cannot guarantee that an advert will be available when you want one, and we are not responsible for the content of an advert or for anything you find by following one.
Where the law requires your consent for personalised advertising, the game will ask for it, and you can change your answer at any time from Menu → Settings.
9. The game may change
We update Odd Socks regularly. We may add, change, suspend or remove features, levels, prices, rewards and rules, and we may stop supporting older versions of the game, without notice. Some changes will be improvements, some will be balancing, and some will be forced on us by a platform we depend on.
The game needs an internet connection and a server we run. We aim to keep it available, but we cannot promise it will always be running, uninterrupted, or free of faults. From time to time we will take it down for maintenance.
If we ever have to close the game for good, we will give as much notice as we reasonably can on our website and in the game. Unspent virtual items will not be refunded.
10. Suspending or closing your account
We may suspend or close your account, remove content, or withdraw items, if we reasonably believe that you have broken these terms, cheated, harmed other players, or used the game unlawfully or fraudulently. Where we can, we will tell you why, and you can reply to us through Support if you think we have got it wrong.
You can close your own account at any time using Menu → Account → Delete Account, or by uninstalling the game – though uninstalling on its own does not delete your data, so that you can come back later and carry on.
11. Facebook, Apple, Google and Amazon
Odd Socks is distributed through platforms run by other companies. Those companies are not parties to these terms, they do not sponsor or endorse the game, and they have no responsibility for it.
For the Apple App Store specifically: these terms are between you and us only. Apple has no obligation to provide any support or maintenance for Odd Socks. If the game fails to conform to any warranty that cannot be excluded, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim relating to the game, including product liability, any failure to comply with legal requirements, and any claim that the game infringes someone’s intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Your use of each platform is also governed by that platform’s own terms.
12. Disclaimers
Odd Socks is provided “as is”. Beyond what we promise in these terms, and beyond the rights the law gives you as a consumer, we do not make any warranty that the game will be uninterrupted, error-free, secure against every attack, or that it will meet your particular expectations.
13. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep all of your statutory rights and nothing here takes them away.
Subject to that, we are not liable for loss that was not reasonably foreseeable when you started playing, for loss of profits, business or goodwill, or for the loss of virtual items or game progress caused by something outside our reasonable control. Where we are liable, our total liability to you is limited to the amount you have paid us for the game in the twelve months before the event that caused it, or £50, whichever is greater.
Odd Socks is a game, played for entertainment. Please do not rely on it for anything that matters.
14. Privacy
Our Privacy Policy explains what we collect, why, and how to have it removed. It forms part of your agreement with us.
15. General
If any part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce a term straight away, we have not given up the right to enforce it later. We may transfer our rights and obligations under these terms to another company, for example if our business is sold; you may not transfer yours without our agreement.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep the benefit of any mandatory protections of your own country’s law, and you may bring proceedings there.
